Virtual Shopping Appointment Booking Terms

1. About us

a. This Service is provided by Value Retail Management (Bicester Village) Limited (“Value Retail”, “we”, “our” or “us”) in collaboration with participating boutiques at Bicester Village (the “Village”).
b. Value Retail a company registered in England under company number 02884096. Our registered office is Management Suite, Bicester Village, 50 Pingle Drive, OX26 6WD.
c. The Village is part of The Bicester Collection. If you receive a similar service from other villages in The Bicester Village Shopping Collection other legal entities will provide it and the identity of those entities will be provided to you at the time.
d. The participating boutiques are all those boutiques offering pre-booked Virtual Shopping appointments via the Service (“Participating Boutiques”), and “Participating Boutique” shall mean the applicable boutique at which an appointment for Virtual Shopping has been made.
e. In these terms “you” means the person using the Service and entering into an Agreement with us and the Participating Boutique which includes these terms.
f. These terms apply to, and set out the basis on which, we and Participating Boutiques will provide, the Virtual Shopping Appointment Booking Service (the “Service”, as further described in section 2). By using the Service, you confirm that you accept these terms.
g. The Service is available to book from 15 March 2021 to 4 April 2021.

2. The Service

a. The is a free Service which enables you reserve an appointment directly with a Participating Boutique in order to access their Virtual Shopping Service. For further information about Virtual Shopping, please see here.
b. Participating Boutiques in the Village are independent companies from us, and as such, they are responsible for all aspects relating to the operation of appointments as part of their Virtual Shopping Service. If you select any items to purchase as a result of the Service, your purchase will be direct with the Participating Boutique involved.
c. Appointments are available to book up to 24 hours in advance via our booking page, which is accessed by following the link available on our website or sent to you via email, WhatsApp or other means.
d. Once an appointment has been booked, you will receive a confirmation email. If this has not been received within 12 hours, please email us at: TheApartment@BicesterVillage.com.
e. Each appointment is for one guest only, unless the Participating Boutique agrees otherwise.
f. The Service is available to adults over the age of 18 only.
g. We reserve the right to refuse to offer or refuse to provide the Service at our sole discretion (provided that we comply the law, e.g. anti-discrimination legislation).
h. These terms apply to the Service and set out the terms on which we provide it. It is a precondition of receiving the Service that you accept these terms in full; your use of the Service constitutes your acceptance.

3. Cancellation

a. If you are unable to attend your appointment, or wish to reschedule, please contact the Participating Boutique directly.
b. If we are obliged to cancel the Service, or if the Participating Boutique is obliged to cancel your appointment, due to events beyond our or the Participating Boutique’s reasonable control, the Participating Boutique will endeavour to contact you as soon as possible, and offer you an alternative date/time. This may become necessary due to unexpected staff absence; if the Village or the Participating Boutique is required to close; or if we are required to make operational changes at the Village as a result of Government or local authority requirements.

4. Data Privacy

a. After you register for an appointment as part of the Service, we will pass the information you enter as part of the booking process to the Participating Boutique to enable them to offer you their Virtual Shopping Service.
b. Participating Boutiques will share with us anonymised information about guest purchases made as a result of the Service to enable us better to understand our guests’ shopping behaviour in order to improve the Service and our guests’ shopping experience.

c. Processing your data in the way described is necessary for us to be able to provide you with the Service. For details about how we collect and process your personal data, please refer to our privacy notice available here: Bicester Village Privacy Notice.
d. Details about how Participating Boutiques collect and process your personal data are available in the Participating Boutique’s privacy notice available on the registration page and in the Participating Boutique’s Virtual Shopping page available here.
e. The Virtual Shopping appointment booking platform is provided by a third party technology partner, Blackthorn.io Inc. When you book the Service, Blackthorn.io Inc will process your personal data on our behalf in order to enable us to operate the Service.
f. Virtual Shopping appointments may be undertaken by a variety of different means by Participating Boutiques, including videocall via Zoom or other platform, and WhatsApp for Business. Please contact the Participating Boutique for further information.

5. Other Important Terms

a. Appointments you have booked are personal to you, and may not be transferred.
b. The Service may not be used in conjunction with any other special offer, coupon, voucher or other offer available at the Village unless we agree otherwise.
c. No failure or delay in exercising any right or remedy provided by law or under this Agreement shall impair that right or remedy, or operate as a waiver or variation of it, or preclude its exercise at any subsequent time. No single or partial exercise of any right or remedy shall preclude any further exercise of that right or remedy or the exercise of any other right or remedy. The parties’ rights under this Agreement are cumulative and may be exercised as often as any party considers appropriate.
d. Each of the provisions of this Agreement is severable. If any provision of this Agreement (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, we agree to amend such provision such that, as amended, it is legal, valid and enforceable, and, to the greatest extent possible, achieves the original intention of the Agreement. Any modification to or deletion of a provision or part-provision of this Agreement shall not affect the validity and enforceability of the rest of this Agreement.
e. We may transfer any of our rights or obligations under this Agreement. You agree not to transfer any of your rights or obligations under this agreement without our consent.
f. We will not be responsible to you for:
i. any financial loss arising out of your failure or inability to take advantage of the Virtual Shopping Appointment on the date and at the time you have booked;
ii. any IT or technology failure which impacts or prevents the quality and/or operation of the Service and/or Virtual Shopping appointments; nor
iii. any failure or inability of the Participating Boutique to attend the Virtual Shopping Appointment, and your sole remedy is such situation will be to contact the Participating Boutique directly and/or book an alternative appointment.
g. You acknowledge and agree that the Participating Boutiques are independent retailers to us and our related companies. As such, we: (i) are not responsible for the prices at which any of the Participating Boutiques at Bicester Village advertises or sells goods from time to time; (ii) make no warranties regarding the goods or services (including without limitation the quality thereof) which you may obtain from the Participating Boutiques; (iii) cannot guarantee availability of access to and/or products available at any of the Participating Boutiques.
h. Nothing in these terms and conditions shall exclude or limit our liability for death or personal injury from our negligence or that of its employees or officers.
i. This Agreement and any dispute or claim relating to it shall be governed by and construed in accordance with English law, and any legal proceedings will be brought in English courts.
